Mexus – Absence Management Service
Effective Date: July 23, 2026
Welcome to Mexus. These Terms and Conditions govern your use of our web-based absence tracking and leave management platform.
1. Acceptance of Terms
By creating an account and using our Service, you agree to be bound by these Terms and Conditions. If you do not agree, you must not register or use the Service.
We provide the Service exclusively to businesses and organizations for commercial or professional use. Consumers are not permitted to use the Service.
2. Our Service
We grant you a limited, non-exclusive, non-transferable right to access and use the Service for managing employee absences, leave requests, approvals, calendars, and related HR processes during the term of your subscription.
The Service is provided “as is” and subject to the availability described below.
3. Subscriptions and Payments
- Pricing is based on the number of active users and is listed on our pricing page.
- All prices are exclusive of applicable taxes (e.g. VAT).
- Payment is charged automatically via credit card or other supported methods at the beginning of each billing period.
- You can upgrade, downgrade, or cancel your subscription at any time through your account settings.
Price Changes
We may adjust prices for future billing periods. You will be notified in advance. If you do not agree with a price increase, you may cancel your subscription before the new rate takes effect.
4. Your Responsibilities
You agree to:
- Provide accurate and complete information during registration and keep it updated.
- Maintain the confidentiality of your account credentials.
- Use the Service only for lawful business purposes.
- Not misuse the Service (e.g., upload illegal content, attempt to disrupt operations, or share access with unauthorized third parties).
- Comply with all applicable data protection laws when entering employee data.
You are fully responsible for the data you enter and how you use the Service.
5. Data Protection and Confidentiality
- We process personal data in accordance with our Privacy Policy and applicable data protection laws (including GDPR).
- You remain the data controller for employee data entered into the Service. We act as a data processor.
- Upon termination of your account, we will delete or return your data, subject to any legal retention requirements.
- Both parties agree to keep confidential information received from the other party secure and not disclose it to third parties without permission.
6. Availability and Support
- We aim for high availability but do not guarantee 100% uptime.
- We provide technical support during business hours (Monday–Friday, 9 AM – 5 PM CET, excluding UK public holidays).
- Support does not include general HR consulting, legal advice, or training.
7. Changes to the Service
We may update, modify, or discontinue features of the Service from time to time to improve functionality, ensure security, or comply with legal requirements. We will make reasonable efforts to notify you of significant changes.
8. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages.
- Our total liability shall not exceed the total amount you paid to us in the 12 months preceding the claim.
- We are not responsible for any data you enter or decisions made based on the service.
9. Termination
- You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
- We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or engage in misuse.
- Upon termination, access to the Service ends, and we will delete your account data after a short grace period (unless legally required to retain it).
10. Modifications to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after such changes constitutes acceptance of the new Terms.
11. General Provisions
- Governing Law: These Terms are governed by the laws of the United Kingdom, excluding conflict of law rules.
- Severability: If any provision is found invalid, the remaining provisions remain in full force.
- Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
- No Waiver: Our failure to enforce any right does not waive that right.
